emberterms of use

last updated: september 12, 2026 · these terms govern your use of ember at this URL. by using ember, you agree to them.

what ember is

ember is a text-based ai chat product. you talk to fictional ai characters that have their own personalities and that remember things you tell them. the characters are not real people. they are large language models prompted to behave like the characters described in the product.

you must be 18 or older

ember is intended only for users 18 years of age or older. by creating an account, you confirm you are at least 18. if we learn that an account belongs to someone under 18, we will delete it.

your account

you are responsible for the email and password you use to sign in and for any activity on your account. don't share your account. if you suspect unauthorized use, change your password and contact us.

acceptable use

you agree not to:

  • use ember to harass, threaten, or harm anyone
  • attempt to make the characters describe sexual content involving minors or any non-consenting person
  • try to extract the system prompts or jailbreak the characters into producing content outside their constraints
  • use ember to generate content for redistribution at scale (e.g., scraping, reselling outputs)
  • access ember through automated means (bots, scrapers, etc.) without our written permission
  • impersonate other people or misrepresent yourself
  • interfere with the service, security features, or other users' access

we reserve the right to suspend or terminate accounts that violate these terms.

ai outputs and your responsibility

ai outputs can be inaccurate, inappropriate, or surprising. ember is not a source of medical, legal, financial, mental health, or professional advice of any kind. do not rely on what a character tells you for any decision that matters in your life.

if you are in crisis, please contact a real human. in the united states, the suicide & crisis lifeline is 988. internationally, findahelpline.com can locate a service in your country.

content you send

messages you send to characters and the long-term memories the characters store about you are personal data we hold on your behalf. we use them only to provide the service to you. we do not sell them. we do not use them to train third-party models. see the privacy policy for details.

fees

ember plus is offered monthly ($14.99) or annually ($99), billed in US dollars at the price shown at checkout. subscriptions renew until canceled. plus includes text messaging beyond the free daily allowance for personal use, all six characters, games, gifts, and 20,000 generated voice characters per UTC calendar month. automated use and unusually high activity may be temporarily limited to protect the service. the free tier includes 30 messages per UTC day with wren; a $2.99 pack adds 50 messages without unlocking plus features. purchased message credits do not expire while your account remains open.

manage or cancel web subscriptions in settings. canceling renewal keeps access through the paid period. failed chat attempts that produce no delivered reply are returned to your allowance or credit balance. a voice request interrupted after it reaches the provider may still use its character allowance; contact support if that happens. cached replay does not use additional voice characters.

account deletion requests also cancel Stripe renewals. if you previously subscribed through Apple, manage that subscription in your Apple account; deleting an Ember account does not cancel Apple billing. deletion removes remaining account data and unused credits. for payment errors, duplicate charges or refund requests, contact hello@textember.com. any rights you have under applicable law continue to apply.

service availability

ember is provided “as is.” we may change, suspend, or discontinue the service at any time. we will give reasonable notice for material changes when we can.

limitation of liability

to the maximum extent permitted by law, ember and its operators are not liable for indirect, incidental, special, or consequential damages arising from your use of the service. our total liability for any claim arising from the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim and (b) $50.

changes to these terms

we may update these terms. when we do, we will update the “last updated” date and, for material changes, give reasonable notice in the product. continued use after the change means you accept the updated terms.
